Sorry to say it, but you're not going to get that replacement. The seller is just a shitface. I've gone through a similar situation on eBay as well..

I ordered a PC game off eBay, and I paid him. He claims he shipped it, but I never got it, so I eventually sent him a message, and he said that he did send it, and that there was supposedly no answer at my door, which is bull because both my mom and I were home that day. So, anyways, I told him to re-ship it to me, and he said "Ok, but you need to pay for shipping again, $10." I told him to just give me my money back, but he waited really long to answer. He eventually said that he's waiting for the item to get back to him, and that when he does, he can only give me the final cost of the auction, minus eBay's fees. Eventually, I gave up, and he managed to keep my $16.

So, basically, he's gonna keep b/s'ing about the shipping. I'd suggest you forward all messages to eBay themselves.

right either ebay, or paypal if thats what you used to pay him. paypal's dispute center stuff works pretty good, and fast. They were able to give me my money back for a performance chip i bought online for my car...needless to say the guy screwed me around, and i got sick of it. so i filed a compliant and received my $3 back for the chip..lol yeah i know performance chip for $3.....yeah i was young and stupid....whateverk

good luck...
